Terms of Service

These Terms govern the use of Anderbuch. Please read them carefully. "We" means the provider named below; "you" means the person using Anderbuch. This is a convenience translation; the German version prevails.

1. Provider and scope

  1. Anderbuch is provided by Elias Tölle, Bulgariplatz 11, 4020 Linz, Austria, email: contact@anderbuch.com (full details in the Imprint).
  2. These Terms apply to all use of Anderbuch through the website anderbuch.com and the installable web app, whatever plan you are on.
  3. Terms of users that differ from these do not apply.
  4. The purchase of paid plans is additionally governed by the terms of our reseller Stripe (see section 9).
  5. By registering, you confirm that you have read and agree to these Terms. You can view, save and print them at any time at anderbuch.com/legal/terms.

2. What Anderbuch is

  1. Anderbuch is an online application for interactive stories. You describe a world or choose an existing one, act or speak in it in your own words, and an AI system continues the story. Anderbuch keeps a record of the world (people, places, relationships, events) that you can view and correct.
  2. For worlds set in existing works, historical periods or real places, Anderbuch may research publicly available information on the internet when the world is created, so that the world is consistent.
  3. Anderbuch is at an early stage of development. Features may change, be added or be removed (see section 12).
  4. Anderbuch is an entertainment service. It is not a source of facts and does not replace legal, medical, financial, psychological or other professional advice.

3. Account

  1. You need an account to use Anderbuch. You can sign in with an email address and password or with your Google account.
  2. Anderbuch is for adults only. You must be at least 18 years old and have full legal capacity, and you confirm this when you register. If we learn that an account belongs to a younger person, we delete it.
  3. Your details must be true. An account is personal and may not be shared with or transferred to others.
  4. Keep your sign-in details secret. If you suspect someone else is using your account, change your password and tell us.
  5. During early access, registration may require an invite code.

4. AI-generated content

  1. Story text is generated by an AI system. It is produced from your input, the record of the world and, where applicable, the research.
  2. AI-generated text can be factually wrong, inconsistent or unexpected. It can resemble existing works. It does not reflect our opinion.
  3. We check text automatically for quality, contradictions and breaches of our Acceptable Use Policy, and may therefore rewrite, shorten or refuse text.
  4. AI-generated text is recognisable as such in Anderbuch: every passage the AI system writes is distinguished in the application from your own input. If you publish text from Anderbuch outside the application, you are responsible for not presenting it there as a factual report or as written by a human where that would be misleading.
  5. Training. We do not use your stories to train AI models, and we instruct model providers neither to retain your content nor to use it for training. The only exceptions require your separate consent (points 6 and 7). Both are voluntary, switched off by default, require a date of birth on your account and have no effect on your plan.
  6. "Help train our writer": if you switch this on in Settings, we may use finished passages from your stories at the "Standard" level, without any link to you, your account or your stories, to train Anderbuch's own narrative model. We do not pass them on to anyone.
  7. The "Muse" voice: on plans where we offer it, you can choose the "Muse" narrative voice. Stories in this voice are sent to Meta Platforms, Inc. on terms that allow Meta to train its AI models on them. Without your consent, such a story is written in the "Writer" voice.
  8. You can withdraw the consents under points 6 and 7 at any time in Settings. Withdrawal takes effect for the future: what has already gone into a trained model or been sent to Meta cannot be recalled. Details are in the Privacy Policy.

5. Content levels and Acceptable Use Policy

  1. Anderbuch has two content levels. Standard (default): suspense, conflict and non-graphic violence are possible; sexual content is not. Mature (after explicit confirmation in Settings): additionally dark themes and more graphic violence; romantic scenes fade to black.
  2. Explicit sexual content is not allowed at any level. Sexual content involving minors is prohibited without exception.
  3. Our Acceptable Use Policy applies to all input, stories and published worlds. It is part of these Terms.

6. Rights in content

  1. Your input and your stories remain yours. Any rights in your input (for example descriptions, characters, worlds) stay with you.
  2. To the extent that rights arise in the AI-generated text of your stories that belong to us, we grant you a perpetual, worldwide, non-exclusive right to use it in any way. Note that AI-generated text is often not protected by copyright under current law, and that similar text may be generated for others.
  3. So that we can operate Anderbuch for you, you grant us the non-exclusive, royalty-free right to store and process your content, to transmit it to the service providers named in the Privacy Policy, and to display it to you. This right ends when you delete the content or your account, except for statutory retention duties and backups, which are deleted when their retention period ends.
  4. Published worlds. If you publish a world, other users may start their own stories in it within Anderbuch and use it (crediting your world) as a template for their own worlds. You grant us and them the corresponding non-exclusive, royalty-free right for as long as the world is published. Only the world and its starting points are published, never your stories. You can withdraw a world at any time; stories others have already started remain.
  5. You may only enter and publish content for which you hold the necessary rights, and you ensure it does not infringe the rights of others.
  6. If you give us suggestions or feedback, we may use them to improve Anderbuch without compensation.

7. Existing works and fan fiction

  1. Anderbuch allows stories in worlds known from existing works for private, non-commercial use. Anderbuch is not affiliated with, endorsed by or reviewed by the rights holders of those works.
  2. Publishing worlds that take over substantial parts of protected works is not allowed.
  3. Rights holders can report suspected infringements through our reporting procedure. We review reports promptly and remove illegal content.

8. Free use and allowances

  1. Basic use is free. Reading and exporting your stories is unlimited on every plan.
  2. Writing new passages is subject to allowances: each plan has a monthly allowance and a rolling five-hour allowance. More elaborate narrative voices count several times. Current plans, prices and allowances are shown on the "Plans" page before purchase; what is shown at the time of purchase applies.
  3. Unused allowances expire at the end of their period and are not paid out.
  4. To prevent abuse, we may set technical limits (for example on the number of simultaneous requests).

9. Paid plans

  1. The seller is Stripe. Paid plans are sold by Stripe (the Stripe company named as seller on the checkout page and on the invoice, where it appears as "Link"), acting as reseller ("Merchant of Record"). The purchase contract for the plan is concluded with Stripe, which processes the payment, issues the invoice and remits the VAT. Stripe's terms, shown to you before purchase, also apply.
  2. Prices are shown before purchase including applicable VAT.
  3. Plans run monthly or yearly and renew automatically for the same period until you cancel.
  4. Cancellation: you can cancel at any time with effect from the end of the current billing period, directly in Anderbuch with "Cancel contract here" (in Settings under "Plan", and on the "Plans" page), without signing in anywhere else. You receive a confirmation by email. Your plan stays active until then.
  5. If a payment fails, your plan stays active for seven more days; after that your account moves to the free plan. Your stories are kept.
  6. Changing plan: you can change to another paid plan at any time on the "Plans" page. The new plan is bought through Stripe's checkout as a new subscription and starts immediately, with a full billing period from that day. The unused part of your current plan is deducted from its first payment; anything left over is credited to your customer balance for later payments. Your current plan ends once the new one is paid; until then, and if the payment does not go through, it stays as it was.
  7. We announce price changes for running subscriptions at least 30 days in advance. They only apply from the next billing period and only if you agree; if you do not agree, your subscription ends at the end of the current period.

10. Consumer right of withdrawal

As a consumer, you have a right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) when you buy a paid plan. The following notice applies.

Withdrawal notice

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Elias Tölle, Bulgariplatz 11, 4020 Linz, Austria, email: contact@anderbuch.com) or Stripe (via the link in your purchase confirmation) of your decision to withdraw from this contract by an unequivocal statement (for example an email). You may use the model withdrawal form below, but it is not obligatory. You can also submit your withdrawal electronically in Anderbuch, with "Cancel contract here" → "Withdraw from the contract". If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (by email) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, you will be reimbursed all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. The reimbursement will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. The reimbursement is made by Stripe.
If you requested to begin the performance of services during the withdrawal period, you shall pay an amount which is in proportion to what has been provided until you have communicated your withdrawal from this contract, in comparison with the full coverage of the contract.

Model withdrawal form

If you wish to withdraw from the contract, please complete and return this form.

To Elias Tölle, Bulgariplatz 11, 4020 Linz, Austria, email: contact@anderbuch.com:
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*): Anderbuch plan …
Ordered on (*) / received on (*): …
Name of consumer(s): …
Address of consumer(s): …
Email address the account is registered with: …
Date: …
Signature of consumer(s) (only if this form is notified on paper)
(*) Delete as appropriate.

Immediate start

When buying, you can expressly request that your plan be activated immediately, that is during the withdrawal period, and confirm that if you withdraw you will pay the proportionate amount described in the notice above. Because a plan starts as soon as it is bought, it can only be bought with this request.
The renewal of an existing subscription does not create a new right of withdrawal.

11. Bring-your-own-key plan (BYOK)

  1. On the "Your own key" plan, you connect Anderbuch to your own account with a supported AI provider (currently OpenRouter or DeepInfra). The prose of your stories in the "Writer" and "Novelist" voices is then generated through your account; other narrative voices are not available on this plan.
  2. Your account with the AI provider is governed exclusively by that provider's terms and prices. You bear the costs incurred there. If your credit there runs out, no new passages can be written; we do not fall back to our own keys.
  3. We store your key encrypted, use it only for your requests, and delete it when you remove it or delete your account. You can also revoke the key with the provider at any time.
  4. All other functions (the record of the world, checks, research) continue to run through our service providers and are included in the plan price.

12. Availability and changes

  1. We aim for high availability but cannot promise uninterrupted access. Where possible, we announce maintenance in advance.
  2. We may change Anderbuch where there is a valid reason (for example new features, security, legal requirements, a change of AI model) and it causes you no additional cost. If a change affects the use of a paid plan more than insignificantly, we will inform you in good time beforehand; you may then terminate free of charge within 30 days of the change.
  3. AI models and narrative voices may be replaced. The character of the text may change as a result.

13. Warranty

The statutory warranty rights apply, in particular under the Consumer Warranty Act (VGG). Because Anderbuch generates stories with AI, it is part of the agreed characteristics that individual texts are unpredictable and may contain errors; you can regenerate, edit or undo them at any time.

14. Liability

  1. We are liable without limitation for damage caused by intent or gross negligence and for personal injury.
  2. For slight negligence, we are liable only for personal injury and for breach of obligations whose fulfilment makes the proper performance of the contract possible in the first place (main obligations); in that case liability is limited to the typical damage foreseeable when the contract was concluded.
  3. We are not liable for the content of AI text you have prompted or for its use outside Anderbuch, unless point 1 or 2 applies.
  4. Mandatory statutory liability, in particular under the Product Liability Act, remains unaffected.

15. Suspension and termination

  1. You can delete your account at any time in Settings. You can export all your stories first. You should cancel a running paid subscription first; if you delete your account, we cancel it for you with effect from the end of the billing period.
  2. We may terminate the agreement for a free account with two months' notice.
  3. For serious or repeated breaches of these Terms or the Acceptable Use Policy, we may block content, restrict features, or suspend the account temporarily or permanently. We give reasons for such measures and take the severity of the breach into account; you can complain against them (see Reports & Contact). If a paid account is permanently suspended, we refund paid, unused periods, except for breaches of the prohibition of sexual content involving minors.

16. Changes to these Terms

  1. We may change these Terms, for example because of new features or changes in the law. We will inform you of changes by email and in the application at least 30 days before they take effect.
  2. Changes that disadvantage you only apply if you expressly agree to them. If you do not agree, we may end the agreement with the notice period in section 15.2; a paid subscription continues on the previous terms until the end of the billing period.

17. Data protection

How we process personal data is explained in the Privacy Policy.

18. Governing law and jurisdiction

  1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer habitually resident in another country, you keep the protection of that country's mandatory provisions.
  2. For actions against consumers who are domiciled, habitually resident or employed in Austria, only the court in whose district that is located has jurisdiction (§ 14 KSchG).

19. Final provisions

  1. If any provision of these Terms is invalid, the remaining provisions remain valid.
  2. These Terms are available in German and English. The German version prevails.
  3. Contact: contact@anderbuch.com.
